Allen Chancey Olson, a 59-year-old paraplegic who was convicted of assault following an incident where he leveled a cocked and loaded pistol at a township supervisor was sentenced by District Judge Bruce Christopherson to serve a minimum of 14 months in prison last Wednseday, Dec. 26.
Olson, of Canby, will begin serving his sentence immediately. Following his 14 month prison sentence Olson was also committed to serve seven months of supervised release. And in addition, Christopherson ordered Olson to forfeit the .357 caliber King Cobra firearm used in the crime, along with a 20-gauge side-by-side double barrel shotgun and ammunition seized by Yellow Medicine County Sheriff’s deputies.
Olson will be granted 39 days of credit to his sentence for time served in the YMC jail.
On Aug. 12, A Yellow Medicine County jury convicted Olson on felony charges of second-degree assault with a dangerous weapon and the making of terroristic threats with reckless disregard of risk.
The conviction and resulting sentence sprung from an incident occurring on July 23, 2008 at approximately 12:00 p.m. in Florida Township near Canby. A township board member, one Curtis Allen Melby, also 59, approached Olson at his residence concerning an on-going issue of cutting a stand of trees which had grown into the right-of-way of a township road and bordered Olson’s property.
While visiting Olson’s residence Melby reported that initially their conversation was cordial. Being classmates, Melby had maintained a standing relationship with Olson. Yet when the conversation turned to the issue of the right-of-way, Olson began to become agitated.
As Olson’s agitation increased he drew the .357 King Cobra and cocked the hammer before leveling it on Melby and asking Melby to leave, as he (Olson) believed Melby was now trespassing.
The following day YMC Sheriff’s deputy Tim Yerigan met with Olson at the YMC fairgrounds in Canby where Olson would be arrested and the 20-gauge shotgun along with ammunition kept by Olson in a stock-sleeve in his vehicle would be seized.
